A woman has lost a legal appeal that banned her from being too noisy in the bedroom. She claimed the court order breached her human rights.
Caroline Cartwright, 48, of Tyne and Wear in the UK, claims she cannot control her shouting and screaming when loving husband Steve.
The Cartwright’s were hit with a noise abatement notice after their postman neighbour complained.
However, the magistrate went further than the neighbour, the local postman, and slapped an anti-social behaviour order (abso) on her as well. The neighbours have complained over250 times.
The Cartwright appealed the conviction and the Asbo, which bans them from “shouting, screaming or vocalization at such a level as to be a statutory nuisance”.
Mrs Cartwright claimed the ruling breached Article 8 of the Human Rights Act which requires “respect for her private and family life”. She claimed that she could not help making the loud noise while making out with her husband Steve..
The Newcastle Crown Court was told that the Cartwright’s nightly sexcapades began at nightly at midnight and lasted two to three hours,
Noise levels were recorded between 30 and40 decibels, the highest being 47 decibels, with equipment installed in the neighbours flat by Sunderland City Council.
The neighbours, whose television viewing was drowned out, described the sound as ”murder” and “unnatural.”
“I did not understand why people asked me to be quiet because to me it is normal” said Mrs Cartwright.
“I have tried to minimize the situation by having sex in the morning – not at night – so the noise was not waking anybody.”
“I may be sympathetic to it but it is not something I am doing on purpose.”
The original conviction was upheld by the Newcastle Crown Court and the Asbo is to stay in force. Breaching an order can result in a 5 year jail sentence.

It seems that Mrs Cartwright finds it hard to do what she’s told.
She kept up[ the noise and as reported on yahoo “Caroline Cartwright was given an eight-week prison term, suspended for 12 months – meaning if she engages in over-noisy coupling again in the next year, she will immediately be put behind bars”
On Friday the judge said: “An anti-social behaviour order was made against you in rather unusual terms,” adding: “The difficulty here is that the first occurrence was the day following the order.
“Then three days later you breached it again. In addition it’s quite clear from the small extract I heard that you made no attempt to silence yourself,” added Bolton.
Passing the suspended sentence, the judge said: “It needs to be a prison sentence because you need to be deterred … If you commit further offences of this nature that sentence will be passed and you will made to serve it.”
